Local Law 147 – Disclosure of Policies on Smoking in Residential Buildings

Effective August 28, 2018, all residential buildings with three or more units will be required by law to create a policy on smoking – including a policy on smoking within residential units – and disclose it to all current and future tenants.

The law requires that owners:

  • Create a policy on smoking and disclose it to current and future tenants.
  • Disclose where smoking is and is not allowed on the property (including all indoor and outdoor locations).
  • Notify tenants yearly about the policy on smoking policy.
  • Notify tenants if the policy on smoking changes.

Building owners are responsible for choosing how to enforce tenant violations.

For more information about the law, including how to comply, visit https://www1.nyc.gov/assets/doh/downloads/pdf/smoke/smoking-disclosure-guide-policy-residential.pdf.

For a sample policy on smoking, visit https://www1.nyc.gov/assets/doh/downloads/pdf/smoke/smoking-sample-policy-residential.pdf. Building owners can use this policy as a model for their building or they can create their own policy.
